Introduction
The "Employee Satisfaction Survey" is a Software as a Service (SaaS) available at https://pulser.hr/ and https://upitnik.hr, owned by the company Alma Career Croatia d.o.o. (hereinafter referred to as: ACC), OIB: 4273924910, located in Zagreb, Strojarska 20, represented by the President of the Management Board, Igor Žonja.
The goal is to enable companies (hereinafter referred to as: Participant) to use the software to assess employee satisfaction and simultaneously raise public awareness about the importance of human resources functions in companies. Through the survey, the best workplaces in the Republic of Croatia are identified based on the experiences and perceptions of their employees.
Annual "Best Employer" Award
Business entities of all sizes can participate in the survey regardless of the number of employees, but only entities with more than 20 employees that conduct the survey among all employees by November 30th of the current year are eligible for the "Best Employer" award. Surveys conducted after November 30th are considered candidates for the next year's award. Participants are not obliged to apply for the award. Participants can conduct multiple surveys throughout the year, but only the first survey conducted in the current year, i.e., after November 30th of the previous year, will be considered for the award.
The award will be given to three (3) Participants in the large company category, three (3) Participants in the medium company category, three (3) Participants in the small company category, one (1) Participant in the "Best new entry" category, and one (1) Participant with the highest overall score in the "Best of the best" category. Additionally, in sectors with a sufficient number of Participants, the "Best Employer in Sector" award will be presented. The name and logo of the Participant will not be published if the Participant is not among the top three (3) in their category.
The "Best new entry" award is given to the Participant who is conducting the survey for the first time and has achieved the highest overall employee satisfaction score among first-time Participants.
Privacy
Participation in the survey is voluntary. The Participant will provide ACC with specific non-public, confidential, and/or private information necessary for the survey process.
Similarly, ACC will provide certain non-public, confidential, and/or private information to the Participant for the survey process.
'Confidential Information' includes data, whether oral or written (stored on any medium), defined as such by the disclosing party at the time of disclosure, intended solely for the purpose of conducting the survey. The obligation to maintain confidentiality does not apply if the disclosure is required by applicable Croatian law or authorized bodies.
ACC reserves the right to use confidential information for group data analysis to publish the best-performing Participants.
ACC will limit access to confidential information to individuals whose official duties involve collecting and analyzing such information for the stated purpose, whether they are ACC employees or external associates engaged by ACC.
Participant Obligations
The Participant agrees to:
1. Provide a relevant sample size based on company size and departments as specified on https://pulser.hr/ if they wish to compete for the "Best Employer" award.
2. Keep the received survey questionnaire and confidential information within the company (not to disclose them to other legal entities).
3. Ensure equal participation opportunities for all employees.
4. Inform employees of the purpose for which their business email addresses will be used when conducting the survey via online questionnaires.
5. Distribute instructions and survey questionnaires to participating employees provided by ACC, if conducting the survey using printed questionnaires.
6. Enter employee data at the group level participating in the survey: educational background, number of employees, and their email addresses; the number of employees refers to the number at the start of the survey regardless of subsequent changes.
7. Adding additional questions beyond the standard survey questions is optional, and the Participant is fully responsible for entering and setting up additional questions correctly.
8. Settle the invoice for the survey within the legal timeframe.
The Participant agrees to consider and, if possible, accept the following advice:
- ACC advises excluding employees who have been employed for less than three months during the survey period, regardless of the type of employment.
- ACC advises excluding employees who have been on sick leave or maternity leave for more than three months during the survey period.
ACC Obligations
ACC agrees to:
1. Conduct the survey at the agreed-upon time with the Participant.
2. Provide instructions to all employees if the Participant provides valid email addresses.
3. Display survey results on https://pulser.hr/ after the survey period ends.
4 Publish a list of the best-performing Participants on https://pulser.hr/ after all Participants' surveys for the current year are completed.
5. Provide Participants with comparative survey results (group comparison with other Participants) after all Participants' surveys for the current year are completed.
6. Issue an invoice after completing the survey. The employee satisfaction survey service includes:
- Conducting the survey via online, printed, or combined questionnaires
- Adding unlimited additional questions
- Filtering basic reports by demographic data and additional questions
- Basic report
- Additional report
- Comparative report
The survey cost is based on the total number of employees within the Participant. The cost is calculated on the official website: Calculator | Pulser;
7. Details of additional discounts for Participants are available on Calculator | Pulser and will be applied when invoicing if the Participant meets the criteria.
8. One year after the survey, ACC will permanently delete employee email addresses entered into the system by the Participant, which were used solely for survey notifications and reminders in the online survey process.
Irregularities
If ACC identifies irregularities during the survey process, it will inform the Participant in writing, and the survey results will not be considered for determining the best-performing Participants.
If the Participant wishes to repeat the survey and compete for one or more "Best Employer" awards, this is possible only once, upon request, and with a written explanation from the Participant. ACC will issue a new invoice for the repeated survey.
ACC reserves the right to exclude certain completed Participant questionnaires from the survey if irregularities are detected.
All legal relationships between ACC and the Participant, in addition to these Terms of Use, are governed by Croatian substantive law, except for conflict of law provisions.
ACC and the Participant will attempt to resolve any disputes amicably. In the event of legal proceedings, the competent court in Zagreb has exclusive jurisdiction.
